Operating a Vessel While Intoxicated. Alcohol & Drug use are Prohibited on this Vessel Coast Guard regulations at 46 CFR Part 95 prohibit any licensed individual, crewmember, pilot or watchtender from: · Performing or attempting to perform any scheduled duty within four 4 hours of consuming any alcohol. · Consuming any intoxicant while on watch or duty. “Intoxicant” means any form of alcohol, drugs or combination thereof. · Being intoxicated at any time on board this vessel. Any individual who is intoxicated while operating a vessel is in violation of the Title 46 United States Code §2302 and subject to penalties for ‘negligent operation’ or ‘grossly negligent operation’. This vessel is also liable ‘in rem’ for civil penalties. Warning Intoxication on commercial vessels is defined as an alcohol concentration of 0.04% by weight.
